Fake Viagra

Frenkels Forensics were instructed to prepare an expert accounting report in relation to a proceeds of crime matter involving a Defendant accused of obtaining criminal benefit in excess of £15 million, from dealing in fake Viagra.

The Defendant, who only held a minor shareholding in a number of connected companies that the Prosecution alleged had dealt in fake Viagra, was nevertheless accused of having benefited in full from the proceeds of crime and faced financial ruin if the case were not successfully defended.

Frenkels Forensics worked alongside their instructing solicitors and Counsel and produced a clear and concise report that showed that the Defendant’s maximum benefit was limited to only £27,000.

We were able to show, through careful investigation and analysis, that turnover was in the main derived from legitimate sources and that the Defendant had not in fact benefited in any material way from the criminal activity.  In addition we were able to show that in some instances the Prosecution’s figures had been incorrectly calculated.

The case was heard at Kingston Crown Court.  During the course of the opening 3 days of the trial, negotiations took place between those acting for the Prosecution and the Defence. Frenkels played a key role in these negotiations.  An agreed settlement was reached on the third day, at a figure of £29,000, this figure being very much in line with our report.  The Defendant was truly grateful to Frenkels Forensics and the defence team, having avoided the loss of the family home and potential financial ruin.
